Helmet Laws
Bicycles: Helmets are required for riders under 18.
E-Bikes:
• Riders under 18 must wear helmets on all classes of e-bikes.
• Helmets are strongly recommended for all adult riders.
E-Bike Classification
Delaware follows the 3-class e-bike system:
Class 1: Pedal-assist only, up to 20 mph.
Class 2: Throttle-assist (without pedaling), up to 20 mph.
Class 3: Pedal-assist only, up to 28 mph.
✔ E-bikes are not classified as motor vehicles and do not require registration, licensing, or insurance.
Where You Can Ride
Sidewalks: Generally prohibited, especially for e-bikes.
Bike Lanes:
• E-bikes are allowed in most bike lanes unless locally restricted.Shared-Use Paths / Trails:
• Class 1 and 2 e-bikes are generally allowed.
• Class 3 use may be restricted unless authorized by local jurisdiction.Roadways: Permitted, as long as riders follow standard bicycle laws.
Age Restrictions
Minimum age of 16 is required to operate a Class 3 e-bike.
No age restriction for Class 1 and 2 e-bikes, though helmet rules still apply to minors.
Lights & Equipment
At night, e-bikes and bicycles must have:
• A white front light visible from 500 feet
• A red rear reflector or light visible from 600 feetAll bikes must have working brakes and reflectors on pedals and wheels.
